These Terms of Service ("Terms") govern your use of the mobile applications published by Evergreen Tools, LLC ("Evergreen Tools," "we," "us," or "our"), including but not limited to Maker Ledger, Everyday Money, and Maker Math (each an "App," collectively the "Apps"), and any other application we publish now or in the future that links to these Terms.

By downloading, accessing, or using any of our Apps, you agree to be bound by these Terms. If you do not agree, do not use the Apps.

1. Description of Service

The Apps provide business and personal finance management tools, including but not limited to expense tracking, budgeting, reporting, and business inventory management. Some features require a paid Premium purchase or a Subscription, as described below.

2. Accounts

You must create an account to use certain features of the Apps. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.

Some Apps allow multiple users to collaborate on shared data (for example, multiple businesses or household members). You are responsible for who you invite to collaborate and what data you share with them.

3. Purchases and Subscriptions

Certain features are available only through a one-time "Premium" purchase or a recurring monthly "Subscription," billed through Apple's App Store.

Subscription Terms:

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the cost of the selected plan.
  • You can manage or cancel your subscription at any time by going to your Account Settings in the App Store after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

All purchases are processed by Apple, and are subject to Apple's own terms and refund policies. We do not process payments or store your payment information directly.

4. User Content

You retain ownership of the data and content you enter into the Apps ("User Content"), including financial records, business data, and any images or attachments you upload. You grant us a limited license to store, process, and display your User Content solely for the purpose of operating the Apps.

We do not review, sell, or use your User Content for advertising purposes.

5. Acceptable Use

You agree not to:

  • Use the Apps for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Apps or other users' data
  • Reverse engineer, decompile, or attempt to extract the source code of the Apps, except as permitted by law
  • Interfere with or disrupt the operation of the Apps

6. Disclaimers

The Apps are provided for general organizational and informational purposes. They are not a substitute for professional financial, tax, accounting, or legal advice. You are solely responsible for verifying the accuracy of any financial calculations, reports, or estimates generated by the Apps before relying on them for business or personal decisions.

The Apps are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

To the maximum extent permitted by law, Evergreen Tools, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Apps, even if we have been advised of the possibility of such damages.

8. Termination

We may suspend or terminate your access to the Apps at our discretion, including if you violate these Terms. You may stop using the Apps and delete your account at any time.

9. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date above when changes are made. Continued use of the Apps after changes are posted constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of New Hampshire, United States, without regard to its conflict of law principles.
